Q: When am I allowed to compensation?

To achieve compensation for our customers, AvioClaim works on the basis of EU Regulation 261/2004 which covers

All flights departing from an EU country, despite the operating airline
All flights arriving into an EU country, operated by an EU airline

Q: My flight is delayed. Am I entitled to claim compensation?

Yes, you can claim compensation for a delayed flight as long as the delay at your final destination is at least 3 hours. The EU Regulation also includes overbooked flights and disruptions generated by a missed connection.

Q: Am I allowed to compensation for a flight cancelled to a country outside the European Union, for example, the U.S?

In this case, you are entitled to compensation only if the flight is operated by an airline from a country in the European Union.
For example, if you fly from Bulgaria to the U.S with American Airlines, you are not entitled to compensation.

Q: What are the “extraordinary circumstances”?

Keep in mind that the airlines often use “extraordinary circumstances” as a way to avoid paying compensation for a delayed or cancelled flight.
According to EU Regulation 261/2004, “exceptional circumstances” are those that “prevent timely execution of a flight, although the carrier has taken all necessary measures to avoid delay or cancellation”.

The list of “exceptional circumstances” includes:

Bad weather (fog/lack of good visibility, strong winds, snow storms, etc.)
Natural disasters
Political or civil disturbance
Strike of the airport sector
Bird strike

Q: How long I should wait to receive my compensation?

AvioClaim submits your request to the airline as soon as we receive the completed form from you. We attempt to settle the claim between 3 to 6 months, but unfortunately, this is something that we cannot predict to the full accuracy. There are cases where the whole procedure ends within 3-4 weeks and you get your compensation just a month after you filed your request.
What we can tell you is that we will keep you informed of the current status of your claim.

Q: Will AvioClaim charge me any fees?

No. we won’t. In fact, you do not have to pay any upfront expenses to use our services. Remember – submitting a claim is completely free.

We operate on a “no win, no fee” principle which means we only get paid if you get paid. If we succeed to achieve your compensation from the airline, we receive a commission equivalent to 20% of the compensation amount ( VAT included).
